These Terms of Service govern your access to and use of the Cortleigh & Sumac website and related online services. By using the website, you agree to these terms.

1. Website Operator

This website is operated by Cortleigh & Sumac. Our online store uses Shopify's ecommerce platform.

2. Eligibility

You must have the legal capacity to enter into a contract or use the website with the authorization of a parent or legal guardian.

3. Acceptable Use

You must use the website only for lawful purposes. You must not:

Attempt unauthorized access to the website or another user's account;
Introduce viruses, malicious code or harmful technology;
Scrape, copy or extract website data without authorization;
Interfere with website security or operation;
Submit fraudulent, false or misleading information; or

4. Website Information

We aim to present accurate descriptions, prices, photographs and availability information. Product colours and appearance may vary because of lighting, photography and screen settings.

We may correct typographical errors, inaccuracies or omissions. Material changes affecting an accepted order will be handled in accordance with applicable law.

5. Products and Availability

Products may be offered in limited quantities. We may introduce, modify or discontinue products, subject to accepted orders and applicable legal obligations.

6. Orders

Submitting an order constitutes an offer to purchase. An automated acknowledgement confirms receipt of the order but does not necessarily constitute acceptance.

A sales contract is ordinarily formed when we send a dispatch confirmation or otherwise expressly accept the order.

7. Refusal or Cancellation of Orders

Before acceptance, we may refuse or cancel an order because of unavailable inventory, payment failure, suspected fraud, inaccurate information, delivery restrictions or an obvious pricing error.

If payment has already been collected for a cancelled order, we will issue an appropriate refund.

We are not responsible for independent third-party content or services, except to the extent that responsibility cannot lawfully be excluded.

If you submit reviews, photographs, comments or other content, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content in connection with our business and marketing.

You must own or have permission to submit the content. It must not be unlawful, deceptive, defamatory, abusive or infringe another person's rights.

The website's original branding, text, graphics, photographs and design are owned by or licensed to Cortleigh & Sumac and are protected by applicable intellectual-property laws.

We are not liable for indirect or consequential loss that was not reasonably foreseeable. Any limitation is subject to rights and remedies that cannot lawfully be excluded.

14. Indemnity

To the extent permitted by law, you agree to indemnify Cortleigh & Sumac against loss resulting directly from your unlawful website use or material breach of these terms. This does not apply to loss caused by our own negligence, breach or unlawful conduct.

16. Governing Law

These terms are governed by the laws of Ontario and the applicable federal laws of Canada. The parties submit to the competent courts of Ontario, subject to any mandatory consumer right concerning applicable law or jurisdiction.

17. Changes to These Terms

We may update these terms prospectively by publishing a revised version. Changes do not remove rights relating to orders already accepted unless permitted or required by law.
